1. Agreement to Terms

These Terms of Service (“Terms”) govern your access to and use of FAImos (the “Service”), provided by FaimosAI Ltd (Company number: 17042011), a company registered in England and Wales with its registered office at 4 Hambleden Drive, Wallingford, OX10 0PQ, United Kingdom (“we”, “us”, “our”). By accessing or using FAImos, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

2. Service Description

FAImos is an AI-powered marketing platform that provides strategy development, campaign creation, and client collaboration tools. Key features include:

AI-powered marketing strategy development
Campaign creation and management
Client collaboration and approval workflows
Content generation and optimisation
Data export and reporting capabilities

3. Account Registration

To use the Service, you must:

Create an account and provide accurate, complete information
Be at least 18 years of age
Comply with these Terms and all applicable laws
Maintain the security of your account credentials

You are responsible for all activity that occurs under your account.

4. Subscription and Billing

4.1 Pricing

Current pricing is available on the FAImos pricing page at faimos.ai.

4.2 VAT

Prices displayed are exclusive of VAT. VAT will be added at the applicable rate when FaimosAI Ltd is VAT-registered and where legally required.

4.3 Payment Terms

Monthly subscriptions are charged monthly in advance
Annual subscriptions are charged annually in advance
Payment is accepted via credit card or other accepted methods

4.4 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.

5. Acceptable Use

You agree NOT to:

Use the Service for any illegal purpose
Generate content that is harmful, harassing, defamatory, or infringes intellectual property
Attempt to gain unauthorised access to the Service or other accounts
Interfere with or disrupt the Service
Send spam or unsolicited communications
Use automated systems to access the Service beyond normal usage
Reverse engineer, decompile, or disassemble the Service
Resell or redistribute the Service without authorisation
Store or transmit malicious code or viruses

6. AI-Generated Content

FAImos uses third-party AI services to generate content. You acknowledge that:

AI-generated content may require review and editing before use
We do not guarantee the accuracy, completeness, or appropriateness of AI outputs
You are responsible for reviewing and ensuring content compliance with applicable laws
AI providers may have their own terms of service that apply to generated content

7. Intellectual Property

Our IP

FAImos, its design, features, and content are owned by FaimosAI Ltd and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

Your Content

You retain ownership of content you create or upload. By using the Service, you grant us a limited licence to host, store, and process your content as necessary to provide the Service.

8. White-Label and Reseller Terms

White-label and reseller programme participants are subject to additional terms:

You may rebrand the Service for your clients as permitted by your plan
You are responsible for your clients’ compliance with these Terms
White-label features are only available on applicable plans

9. Data Protection

We process personal data in accordance with our Privacy Policy and the applicable data protection laws in your jurisdiction, including the UK GDPR, New Zealand Privacy Act 2020, Australian Privacy Act 1988, South Africa’s POPIA, and the CCPA/CPRA. For business customers processing personal data, our Data Processing Agreement applies.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

Consumer protection notice

Nothing in these Terms excludes or limits any rights you have under mandatory consumer protection legislation in your jurisdiction, including but not limited to:

United Kingdom — Consumer Rights Act 2015 (services must be performed with reasonable care and skill)
New Zealand — Consumer Guarantees Act 1993 (guarantees as to reasonable care and skill, fitness for purpose)
Australia — Australian Consumer Law, Schedule 2 of the Competition and Consumer Act 2010 (consumer guarantees that cannot be excluded)
South Africa — Consumer Protection Act 2008 and Electronic Communications and Transactions Act 2002

Where any statutory consumer guarantee applies, our liability is limited to the re-supply of the services or payment of the cost of having the services supplied again, as permitted by the applicable legislation.

11. Limitation of Liability

To the maximum extent permitted by law, FaimosAI Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of FAImos.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Cooling-Off Period

If you are a consumer in South Africa, you have the right to cancel an electronic transaction within 5 business days of concluding the transaction, in accordance with the Electronic Communications and Transactions Act 2002 (Section 44). To exercise this right, contact us at hello@faimos.ai.

This cooling-off right applies in addition to any cancellation rights provided elsewhere in these Terms.

13. Termination

We may suspend or terminate your access to the Service at any time for:

Violation of these Terms
Non-payment of fees
Suspected fraudulent activity
Prolonged inactivity

Upon termination, your right to use the Service ceases immediately. You may export your data before account closure.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

However, nothing in these Terms limits your right to bring proceedings in the courts of your country of residence, or to benefit from any mandatory consumer protection laws of your jurisdiction, including those of New Zealand, Australia, South Africa, or the United States.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the Service. Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.
